4. Personally identifying information, such as acreage treated or exact location, should not be included—this is critical to grower, applicator and employee safety

drift nor fuming problems. We live in our orchards and are concerned about exposure ourselves. We are not going to put our families and workers at risk. Our workers wear their PPE; safety googles or glasses , face shields, gloves, masks,etc when mixing and loading, spraying as required for safety on our PCA written recommendations. Labor crews are notified of all sprays in the last month before they enter the fields after the required interval on the label. ( the label is the law)

2.We are highly regulated and the public is able to use many products around their home with no requirement for safety, no recommendations on use, no required PPE and a lot or that could end up in our waterways, in the air and on them. They are literally poisoning themselves. They should be required to follow the same guidelines as us for their own and others protection

3.. Notification should be limited to pesticide products that are already subject to notices of intent.

4.Timeframes to submit Notices of Intent to County Agricultural Commissioners should remain as it is in current practice,

5. Too many restrictions or loss of products for crop protection will result in poor quality crops and the inability to feed our country which couId lead to loss of farms and mass starvation, as we can't feed the world now.

6.Public notifications should only include what information is absolutely necessary; product applied, intended date and time of application,and general geographic location ( base, meridian, township,range and section). Not exact location

7 .Personally identifying information. such as acreage treated or exact location, should not be included--this is critical to the grower, applicator and employee safety. Plus protestors could come and interfere with the farming operations and expose themselves to chemical contamination as they wouldn't have the necessary PPE.

8.Because of the high probability that advance notice will trigger appeals of NOls am stall applications. the Department should prepare for these administrative burdens, act quickly to protect the right to farm, and for extended liability for crop loss due to the delay or inability to spray.

As this system is implemented, I encourage the Department to engage early and often with the agricultural community to be sure that negative consequences are managed.

Toretta Farms is a 1600 acre family farm consisting of row and permanent crops in Kern County. CDPR’s Proposed Advance Pesticide Notification System would place more unnecessary, draconian and expensive regulations to the already excessive rules, regulations and fees California farmers are burdened with.

We urge CDPR not to approve the Proposed Advance Pesticide Notification System. If approved this would be another severe blow to an already struggling California industry.

My name is David Phippen and my 3 partners and I farm almonds in San Joaquin and Stanislaus Countys. We also hull & shell almonds for customer growers in Californis and also pack and market almonds for many of those same growers. We ...

We grow approximately 2500 acres owned by various Family Member Partnerships. We use farm protective chemicals on all of this acreage and do our best to be the best stewards of the land and also be good neighbors to those folks who also live here in California.

We are writing to you today to share with you that we are adamantly opposed to your proposed new notification system concerning our use of farm chemicals. We currently notify the county ag commissioner when we apply restricted chemicals. The current system serves us and our adjacent neighbors very well. Placing our private chemical application intentions on the web—to folks whom may not live anywhere close to our application site is completely against our privacy needs. Furthermore, such notice will likely attract those members of our nation whom are completely opposed to the legal use of farm chemicals to our application sites. Such attraction will likely expose more citizens to our chemical application operations. How can this be helpful??

Please give pause and second thought to this misaligned idea of mass notification of our private farming matters.

I really like the idea of a pesticide notification system to shed light on potential harm from pesticide drift, but it looks to me like your plan will still keep the public in the dark. It won't tell us where within a one-mile square the applications will be made. There's a big difference in the threat from pesticides drifting from across the street versus from across town. We would be much more cautious when the spraying is close nearby, but the system you propose will not tell us that. We need to know the exact location of the pesticide application. Comments/Comentarios: Exact location notification is indeed neccessary so we know where the site application is at so we can avoid stepping into contaminated soil and bringing it into our home or risk unwanted drift. There are times that it is applied in front of homes so one would assume the homeowners can see it and are aware so as to not venture outside or near the site but if you don't live in that particular neighborhood and walk along the site like I did, you are putting yourself at risk without knowing it. I was walking along E Los Angeles Ave here in Shafter, which if you don't know, has no sidewalks or safe space to walk so joggers and walkers either have to go into the road or into the dirt. That time it was starting to get hot so I decided to walk in the orchards for shade and to avoid any morning traffic. While in there I smelled something vaugely sweet and familiar but it was also affecting my breathing and caused some muscle spasms. I remembered smelling this once from my dad's work clothes, he is a field worker, when he would work in pesticide spraying and sure enough I saw an application tank pass by the rows in front of me. I had no choice but to run back to the road to avoid getting hit or sprayed. There were no signs outside warning of trucks entering or spraying.

We have a community garden behind Sequoia Elementary along Fresno Ave in Shafter and many have seen planes spraying so close to the almond orchards, which are a considerable distance from us, that drift still makes contact with us while we are out there trying to maintain a pesticide-free garden. When one of our members asked what was being sprayed the foreman ignored him before eventually telling him it was sugar water. Whether it was true or not we have older persons and families coming out to grow clean food and take some time to do healthy activites for the good of their health and their families health. But how can we when not even the air we breathe is healthy and many of us are developing breathing problems or our children are being born with breathing problems? A healthy community stems from a healthy environment. Statewide notification with exact location of site application is a must and must be a neccessity, not a suggestion.

Comments/Comentarios: If you're from the Valley, you know how important agriculture is to our communities. It provides jobs and opportunities for farmworkers and their families. However, an aspect that affects households and communities that live in close proximity to agricultural fields is the application of pesticides; pesticides that have caused health impacts to families and farmworkers alike. The planned community announcement system does not take into account the fact that pesticides can spread farther than the planned one mile radius notification, and providing only the general area undermines the purpose of these alerts. What happens if pesticide is applied near the boundary of the one mile area? What about the people who live on the other side of that boundary? Knowing exactly where pesticide is being applied is important for residents to plan accordingly for their health, and safety. When harmful gasses are being sprayed into the air, our gas companies notify us with the exact location or at the minimum cross streets where the leak is located. Why can't DPR, an agency who's mission is to protect the environment and people from pesticide-use, do the same? My ask is for the planned notification system to provide exact location of where the application is occuring.

Dear Director,

I am writing to you today to ask you to strengthen the draft regulation for a statewide pesticide notification system to include the exact location of planned pesticide applications, and a process for ensuring that the regulation will be revised in response to community feedback.

For many years now, residents of farmworking communities have been calling for advance warning of pesticide use near their homes and schools. The draft regulation represents a significant and welcome step toward transparency regarding chemical use by the agricultural industry.

However, a series of pilot notification projects in 2022 confirmed that, without exact location of planned applications, it is difficult to take steps to prevent exposure to pesticides. Your Department received extensive feedback from the pilots calling for detailed location information, but has refused to standardize the location information so that it can be provided to the public.

This regulatory process is the perfect opportunity to standardize this information. It?s impossible to justify designing a public health notification system that deliberately fails to disclose known location information. I ask you to revise the regulation to include the exact location of all pesticide applications included in the system.

Furthermore, DPR has repeatedly stated that the regulation represents a first step toward a robust notification system, and that the regulation will include a process for community feedback and improvement. However, the current draft includes only a report on the regulation by DPR staff after three years.

I ask you to honor your commitment to establishing a truly iterative process for the regulation, by establishing an annual community advisory panel and including a commitment to make needed changes to the regulation based on the panel?s feedback.

For decades fumigants and pesticides have been used and overused. It is necessary that we learn that these are tools that cause harm to many families and entire communities. There are other tools that can be used and natural organic solutions that have not been exhausted. The greed for maximum profits is what drives the companies to continue using these products when reality is workers do not receive proper training and are not compensated when they get

sick or permanently disabled. Your mission is to protect human health and I ask you to do this because at this time you are failing. We as an organization have taken dozens of community members talk about their illness or cancer or miscarriage's linked to this pesticide's exposure. You are slowly doing the work that needed to happen a decade ago and continue to poison our most vulnerable and our children.

Those pesticides affect me directly because they have an affect on those of us that live close to the fields. I live in the area of Fresno CA and for a long time I was exposed to the area where I smelled very strong odors maybe from pesticides or things applied in the fields.

And it has caused me to have blemishes, bumps and discoloration on my skin and also caused some kind of allergic reaction. After many years of these reactions the issues have gotten worse. I worry that many more people will have consequences like me and suffer. Where we live causes us to be exposed and that is not safe. Please do what you can to protect our health and the health of our families and do what is necessary to better the program that can protect us but also all the people that work in agriculture for many hours and have a maximum exposure.

I live in Ventura County, called "Cancer Alley." I volunteer at Mesa Farm in the heart of Ojai Valleys agricultural area where residences are located among long-time orange orchards whose owners continue to practice aerial spraying. This endangers the youth who come to live at Mesa Farm to gain a strong, rewarding direction in life. Local spraying is a serious health risk. Notification with dates and locations of spraying should be mandatory.

For many years now, residents of farmworking communities have been calling for advance warning of pesticide use near their homes and schools. The draft regulation represents a significant and welcome step toward transparency regarding chemical use by the agricultural industry.

However, a series of pilot notification projects in 2022 confirmed that, without exact location of planned applications, it is difficult to take steps to prevent exposure to pesticides. Your Department received extensive feedback from the pilots calling for detailed location information, but has refused to standardize the location information so that it can be provided to the public.

This regulatory process is the perfect opportunity to standardize this information. It?s impossible to justify designing a public health notification system that deliberately fails to disclose known location information. I ask you to revise the regulation to include the exact location of all pesticide applications included in the system.

Furthermore, DPR has repeatedly stated that the regulation represents a first step toward a robust notification system, and that the regulation will include a process for community feedback and improvement. However, the current draft includes only a report on the regulation by DPR staff after three years.

I ask you to honor your commitment to establishing a truly iterative process for the regulation, by establishing an annual community advisory panel and including a commitment to make needed changes to the regulation based on the panel?s feedback.

Thank you for taking this step toward transparency in agriculture.
